End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you and TubeLearn ("we," "us," or "our") governing your use of the TubeLearn mobile application for iOS and Android (the "App"). It supplements, and does not replace, our Terms of Service and Privacy Policy, which also apply to your use of the App. If you do not agree to this EULA, do not download, install, or use the App.

1. License Grant

Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on an Apple or Android device that you own or control, solely for your personal, non-commercial use, and solely as permitted by the Usage Rules set out in the applicable app store's terms of service (App Store or Google Play).

2. Scope of License

This license is limited to a non-transferable license to use the App on any device you own or control, as permitted by the app store Usage Rules. You may not: distribute or make the App available over a network where it could be used by multiple devices at the same time; rent, lease, lend, sell, redistribute, or sublicense the App; copy, decompile, reverse-engineer, disassemble, or attempt to derive the source code of the App, except and only to the extent applicable law expressly permits despite this limitation; or remove, obscure, or alter any proprietary notices in the App.

3. App Content and Third-Party Services

The App generates Lessons (study guides, cheat sheets, and quizzes) from publicly available YouTube video captions using AI. AI-generated content may be inaccurate, incomplete, or misleading — see Section 5 of the Terms of Service. The App relies on third-party services, including the YouTube Data API and Google/Apple sign-in and billing services, which are subject to their own terms and are outside our control. We are not responsible for the availability or accuracy of third-party services the App depends on.

4. Subscriptions and In-App Purchases

Paid plans (currently Plus) are sold as auto-renewing subscriptions through the App Store or Google Play and billed by Apple or Google, not by us. Pricing, renewal, cancellation, and refunds for these purchases are governed by the app store you subscribed through and by our Refund Policy. You can manage or cancel a subscription at any time in your device's app store account settings.

5. Maintenance and Support

We are solely responsible for providing maintenance and support for the App. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the App. Support requests can be sent to hello@tubelearn.app or through our Support page.

6. Warranty

The App is provided "as is" and "as available" without warranty of any kind, to the fullest extent permitted by applicable law, as set out in Section 10 of our Terms of Service. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, as applicable, and they may refund the purchase price (if any) for the App to you; to the maximum extent permitted by applicable law, Apple and Google have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility.

7. Product Claims

We, not Apple or Google, are responsible for addressing any claims by you or a third party relating to the App or your use of it, including: product liability claims; claims that the App fails to conform to any applicable legal or regulatory requirement; and claims arising under consumer protection, privacy, or similar legislation.

8. Intellectual Property Claims

We, not Apple or Google, are responsible for the investigation, defense, settlement, and discharge of any claim that the App or your possession and use of it infringes a third party's intellectual property rights.

9. Legal Compliance

You represent that you are not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you are not on any US government list of prohibited or restricted parties.

10. Third-Party Beneficiaries

You acknowledge and agree that Apple, Google, and their respective subsidiaries are third-party beneficiaries of this EULA, and that, upon your acceptance, each will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

11. Termination

This license is effective until terminated. Your rights under this EULA terminate automatically if you fail to comply with any of its terms. We may also suspend or terminate your access to the App as described in Section 9 of the Terms of Service. Upon termination, you must stop using and delete the App from your device.

12. Changes to This EULA

We may update this EULA from time to time. Material changes will be noted by updating the date at the top of this page. Continued use of the App after changes take effect constitutes acceptance.
